Terms & Conditions

1. Introduction

Welcome to VoisoSMS ("Platform"), operated by Wazaza Ltd, a company incorporated in the Republic of Cyprus ("Wazaza", "we", "our", or "us"). These Terms & Conditions govern your access to and use of the VoisoSMS platform and related services. By creating an account or using the Platform, you agree to these Terms.

2. About VoisoSMS

VoisoSMS is a Software-as-a-Service (SaaS) platform that enables customers to automate SMS campaigns using their own Voiso account. The Platform provides:

  • Contact list management
  • Bulk SMS campaign automation
  • Campaign scheduling
  • Delivery status monitoring
  • Analytics
  • Voiso API integration

VoisoSMS does not provide telecommunications services or SMS delivery.

3. Independent Service

VoisoSMS is an independent software product developed and operated by Wazaza Ltd. Unless expressly stated otherwise:

  • Wazaza Ltd is not owned by Voiso.
  • Wazaza Ltd is not operated by Voiso.
  • Wazaza Ltd is not officially endorsed by Voiso.
  • All trademarks remain the property of their respective owners.

4. Customer Requirements

To use VoisoSMS you must:

  • Have a valid Voiso account
  • Maintain sufficient SMS credits with Voiso
  • Keep your API credentials secure
  • Comply with all applicable laws

5. SMS Delivery

Wazaza Ltd does not transmit SMS messages. All SMS messages are transmitted, routed, billed, and delivered by Voiso through Voiso infrastructure. Wazaza Ltd cannot guarantee delivery rates, delivery speed, carrier acceptance, routing, or message completion.

6. Subscription

Access to VoisoSMS requires an active subscription. Current plans include a Monthly Subscription and an Annual Subscription (Early Adopter). Subscriptions automatically renew unless cancelled before renewal.

7. Payment

Payments are processed securely by Stripe. Subscription fees are non-refundable and exclusive of applicable taxes unless stated otherwise. Failure to pay may result in suspension or termination.

8. Acceptable Use

Customers agree NOT to use VoisoSMS for:

  • Spam
  • Fraud
  • Phishing
  • Malware
  • Illegal gambling where prohibited
  • Adult content where prohibited
  • Harassment
  • Terrorism
  • Hate speech
  • Scam campaigns
  • Political campaigns where prohibited
  • Any unlawful activity

Violation may result in immediate suspension.

9. Customer Responsibilities

Customers are solely responsible for:

  • recipient consent
  • GDPR compliance
  • local SMS regulations
  • marketing permissions
  • contact list accuracy
  • campaign content

10. GDPR & Privacy

Customers must ensure they have a lawful basis to process personal data. Wazaza Ltd acts as a software provider and processes data only as necessary to provide the Platform.

11. Intellectual Property

All software, source code, branding, documentation, and content remain the exclusive property of Wazaza Ltd. No license is granted except to use the Platform during an active subscription.

12. Availability

We aim for high availability but do not guarantee uninterrupted service. Maintenance, third-party outages, or Voiso service interruptions may temporarily affect availability.

13. Limitation of Liability

To the maximum extent permitted by law, Wazaza Ltd shall not be liable for failed SMS delivery, delayed delivery, carrier filtering, Voiso downtime, API changes, incorrect customer data, lost profits, indirect damages, or business interruption. Our total liability shall not exceed the subscription fees paid during the previous 12 months.

14. Termination

We may suspend or terminate accounts that violate these Terms, abuse the Platform, fail to pay subscription fees, or engage in unlawful activity.

15. Governing Law

These Terms are governed by the laws of the Republic of Cyprus. The courts of Cyprus shall have exclusive jurisdiction.
